What to know about Day 2 of the Trump disqualification trial in Colorado
The 14th Amendment disqualification trial against former President Donald Trump continued Tuesday in Colorado, where a group of voters are trying to keep him off the 2024 ballot based on the Constitution’s post-Civil War “insurrectionist ban.”
An expert on right-wing extremism dissected Trump’s history of fomenting unrest and testified that Trump’s speech on January 6, 2021, was unmistakably interpreted by his most militant supporters as “a call to violence.” This is a key part of the challengers’ argument that Trump “engaged” in the insurrection and is therefore ineligible for office.
The battle over Trump’s spot on the ballot has heated up. While the trial played out in Colorado, Trump filed a lawsuit to shut down a similar case in Michigan. And a major hearing is set for Thursday in Minnesota in another anti-Trump candidacy challenge.
The 14th Amendment says US officials who take an oath to uphold the Constitution are disqualified from office if they “engaged in insurrection” or aided the country’s enemies. But the Constitution doesn’t say how to enforce the ban, and it has only been applied twice since the 19th century, which is why many experts view these challenges as a legal long shot. — CNN
Our Take: “Day two of the trial to disallow President Trump from the Colorado 2024 Presidential Ballot was hilarious. The first "expert" witness from the petitioners was a sociologist named Pete Simi that specializes in far right extremism. Key takeaways from his testimony:
(1) Far Right Extremists are those who believe that corruption is a significant problem and that special interests are running the world. According to the NY Times 2022 Siena Poll (Oct 18, 2022) that includes 68% of the nation — and that was before the 2022 midterm debacle.
(2) Alex Jones, Enrique Tarrio, Stuart Rhodes, and Nick Fuentes are far right extremists that President Trump communicates to via coded messages and dog whistles so that he has plausible deniability for their actions.
(3) The Charlottesville 'Unite the Right' rally was a predecessor to January 6, and a good example of how Trump endorses the behavior of 'his followers' and should be extrapolated to the events of January 6. The very fine people clip was played — without the condemnation — by the petitioners while the full clip was played by Trump's attorney.
(4) When Trump says something, he means the opposite. The 'expert' calls this doublespeak and, while we all engage in doublespeak, far right extremists do it as a call for violence. That is, when he says 'peacefully and patriotically,' he really means to incite violence and far right extremists know this.
(5) Typing in all caps and speaking about 1776 are signs of escalating extremist behavior — this is a real assertion by this 'expert.'
(6) Only trained social scientists who have analyzed and profiled Trump can understand that his words actually mean the opposite of what they sound like, so we need to trust them because of all their research and, no, it's totally not confirmation bias.
He was rightly destroyed on cross examination, said 'um' and 'uh' so many times we had to call off the drinking game, and admitted that he had no direct evidence of President Trump actually inciting anything. They also played a montage of Democrat elected officials actually inciting violence in 2020, and the social scientists was proved an absolute fraud.
The second 'expert' witness to testify was a self-described 'Homeland Security expert,' though he admitted that he has never advised a government executive branch, state or federal, and he has never actually been in a real crisis — but he has simulated a bunch of them in an academic setting.
The petitioners have had four witnesses drop out of testifying, and this case is a highly laughable — but very dangerous — attack on First Amendment protected speech and activities. The precedent they are attempting to set is Minority Report. Tune in this week for live event coverage on Badlands.

'Hundreds' Wounded & Dead After Israel Strikes Refugee Camp In Gaza, IDF Spox Shrugs Off Civilian Deaths
There's been more confirmation of the Israeli airstrikes on a densely populated refugee camp in Jabaliya neighborhood, which lies north of Gaza City. Israel's military has owned up to it, saying an important senior Hamas commander who helped plan the Oct.7 terror attack was eliminated. Al Jazeera is citing health sources at the nearby "Indonesian Hospital" to say that at least 50 Palestinians have been killed, mostly civilians, and that number is expected to rise. "Hundreds" are said to have been injured and killed in the attack, per Sky News.
But when an IDF spokesman was pressed by CNN's Wolf Blitzer over why Israel chose to attack even while knowing hundreds of civilians were there, he essentially explained that eliminating the Hamas commander was more important than safeguarding civilian lives (see exchange below). The New York Times has detailed of the massive strikes on the neighborhood area and refugee camp:
The Gaza Health Ministry, which is controlled by Hamas, said the Israeli strikes killed and wounded “hundreds” of people in the Jabaliya neighborhood, a statement that could not be immediately verified. A doctor at a nearby hospital said the facility was receiving hundreds of injured and that dozens were dead.
Israel’s military said in a statement that its fighter jets, in a “wide-scale” attack, had struck Hamas militants, including a commander who helped plan the Oct. 7 massacre that left 1,400 people dead, mostly civilians.
“His elimination was carried out as part of a wide-scale strike on terrorists and terror infrastructure belonging to the Central Jabaliya Battalion, which had taken control over civilian buildings in Gaza City,” the military said.
It reiterated a warning for Gazans to evacuate south, a call that came as Israeli ground troops and tanks pushed deeper into the Gaza Strip and were edging closer to the territory’s main city. More than half the population of two million people has been displaced since Israel expanded a blockade of the enclave in response to Hamas attacks that killed 1,400 people. — ZeroHedge

US House Republicans' Israel-only aid bill opposed in Senate, by Biden
U.S. senators from both parties voiced doubts on Tuesday about House Republicans' plan to provide $14.3 billion in aid to Israel by cutting Internal Revenue Service funding, without providing aid to Ukraine, and Democratic President Joe Biden threatened to veto the bill were it to pass.
In the first major legislative action under new Speaker Mike Johnson, House of Representatives Republicans unveiled a standalone supplemental spending bill only for Israel on Monday.
This is despite President Joe Biden's request for a $106 billion package that would include aid for Israel and Ukraine and funding to boost competition with China in the Indo-Pacific as well as security along the U.S. border with Mexico.
Republicans have a 221-212 majority in the House, but Biden's fellow Democrats control the Senate 51-49. To become law, the bill would have to pass both the House and Senate and be signed by Biden.
The top Senate Democrat said the Republican bill would be dead on arrival in the upper chamber, even if it passed the House.
"The bottom line is it's not a serious proposal," Senate Democratic Majority Leader, Chuck Schumer, told reporters.
The administration said Biden would veto such a bill were it to reach his desk. — Reuters
Our Take: “This week,
and I speculated on the various outcomes that could result in Speaker Johnson's deployments from an America First perspective.One such scenario I speculated on involved the America First agenda getting a Narrative win, while presenting no Actual damage to the movement, in the form of the proposed, unified spending package to Israel and Ukraine being DOA in the House, while Johnson's bifurcated proposal would be DOA in the Senate.
What this move could accomplish is allowing the Biden Admin and Establishment-controlled Senate to take the blame from pro-Israel AND pro-Ukraine war hawks on both sides of the illusory aisle as Johnson's demand to bifurcate said packages results in no money going to either Proxy War.
Of course, I'm one of those kooks who believes much of what we're being told about spending packages is purely for optics, but it's fun to play out the scenarios either way.

"The Bellwether Has Sounded": Musk Says "Great Wakening From Woke Has Happened" After Southpark Nails Coffin
The backlash to woke culture - which is championed by annoying, politically correct, judgemental, authoritarian, censorious, hypocritical self-anointed masters of the universe - is reaching a crescendo.
Last week we noted how Disney punted it's Snow White remake into 2025 as Southpark destroyed them for woke casting in general.
Also last week, Arkansas Governor Sarah Huckabee Sanders (R) signed an executive order eliminating 'woke, anti-women words' from state government use.
There's even a "get woke go broke" ETF in the works, an 'anti-woke AI chatbot', oh - and the fact that forcing woke trans culture down the throats of Bud Light consumers has killed the brand.
In short, corporations have realized that going woke is killing profits.
To that end, on Monday, Twitter owner Elon Musk declared "The great wakening from woke has happened," which he says is "good for civilization." — ZeroHedge
Our Take: “When the much-promoted South Park: Into the Panderverse special aired last weekend, I saw some gnashing of teeth in the Truth Community by many Anons and citizen journalists who’ve been calling out the woke mind virus for almost a decade, saying that the creators of the infamous satire missed the boat on anti-woke sentiment and arrived too late.
While it’s absolutely true that South Park—and most of the mainstream comedy space—only joke about such things when it’s safe to do so, I think we should focus on the fact that the current persuasion of the Collective Mind is leading multi-billion dollar corporations into the belief that the time is now to deploy such ‘controversial’ comedy.
The tide has turned on the woke mind virus, which, if politics is downstream of culture, means the tide has turned on [them.]” —

Former Fox News Reporter Refuses to Reveal Source, Faces Contempt Charge
A reporter who was with Fox News when she reported on information provided by a confidential source is facing a contempt charge because she's refusing to reveal the source's identity despite a court order that she do so.
Catherine Herridge, who is now a reporter for CBS News, was ordered in August to disclose the identity and motive of the source, who provided information about an FBI investigation into a Chinese American scientist.
But Ms. Herridge, during a deposition after the order was handed down, "refused to answer questions regarding the identity of her confidential source(s) and other aspects of her reporting process and editorial decision-making," lawyers for Yanping Chen, the scientist, said in a recent filing. — The Epoch Times
Biden exchanged up to 82K pages of emails under pseudonyms while VP: lawsuit
President Biden sent or received up to 82,000 pages worth of private emails while serving as Barack Obama’s vice president, the National Archives disclosed late Monday as part of a lawsuit brought by a conservative organization.
The Archives revealed that the trove of correspondence spanned all eight years of Biden’s vice presidency and included messages to or from three shadow email addresses: “robinware456@gmail.com,” “JRBWare@gmail.com” and “Robert.L.Peters@pci.gov,” according to a joint filing with the Georgia-based Southeastern Legal Foundation.
“The fact that as vice-president, Joe Biden sent 82,000 pages of emails from alias email addresses is shocking,” Southeastern Legal Foundation General Counsel Kimberly Hermann told The Post.
“The American public has a right to know what is in those emails. SLF remains hopeful that now that we have confirmed that the emails exist, NARA will fulfill its legal obligation and produce them in a timely and transparent manner.”
It is unclear what topics are covered in most of the emails or who else was looped in on the messages. — The NY Post
