I cannot believe I am the only person thinking that a State Court cannot find him guilty of a Federal crime where they had no jurisdiction and use that false verdict as the basis to enforce Election interference in their state. This is absolute lunacy. Worse than a Clown Court. And calling the "Majority" of this State Supreme Court ruling anything but politically biased is like saying the President of Harvard has a right to have the title of Doctor in front of her name.

There exist numerous ways in which SCOTUS can overturn this ruling. It will be interesting to see which one they take; but it is almost certain that they will hear this appeal, because post-2020 the court was quite clear on one thing: the courts should not interfere with the peoples' choices regarding elections. They followed this approach 'to a T,' even when it seemed to most observers that at least some of the election fraud cases had merit, TX vs PA most notably.

That approach almost guarantees that SCOTUS must address the question: must lower courts also keep 'hands off' the electoral process? Regardless of the validity of the arguments or positions of the parties to the case, do the courts have authority to act in such a way as to put their 'fingers on the scales' of electoral justice?

I expect the Court to say that the lower court should never have even taken this case -- it should have been dismissed on the basis that the state courts do not have jurisdiction over the application of federal law to federal elections, especially where there is no clear precedent. Not to mention the factual problems -- Trump has not been convicted (nor accused) of insurrection; and the lack of clarity regarding the true meaning of section 3 of the 14th Amendment, which as I understand it has never been adjudicated in any court.

SCOTUS in its previous actions has demonstrated strong disdain for judicial activism, especially when it comes to interference with elections, and I expect them to continue that position here.

Those were the first words out of my husband’s mouth yesterday after the Colorado Supreme Court decision came out. I think the Distract Court judge mentioned insurrection in her decision to set this up. Because he couldn’t be charged with insurrection at the State level but it had to be argued in trial to justify keeping off the ballot then by mentioning it in the decision sets it up for the Supreme Court to rule the way they did.

You nailed it Andrew, Clown Court. We don't have real forums of law in this country. They occasionally act like it but in substance they have never been and never will be unless so major changes take place and they reveal what they really are to the people—private bar guide commercial courts that are there to manage the "lunatics" that are the people.

But to your point, the people don't know this and we should be calling the courts out on it.

What a great way to start the day! The rule of law is obviously at the forefront during the last few days of 2023 and that likely IS intentional as is Vivek’s withdrawal from the Colorado primary. It will be interesting to see if the other lame stream candidates will meet his challenge. Now, it is also obvious why the hate and attacks against Justice Thomas have sharply increased again, after several months of relative silence.🤫 Part of this case will definitely reveal the infiltration and corruption of much of the lower courts. Nevertheless, the Justices’ will have to make some decision on whether Trump had anything to do with the J6 insurrection. Or, will their ultimate decision reveal the fact that the real insurrection was the 2020 election and

They do not need to (and in fact, should not) address any of the material facts of the case, if the case is legally unfounded in the first place. The state court should have (as Trump's attorneys petitioned) thrown this case out without a hearing of fact because they have no jurisdiction regarding application of federal law to an election. A case based on federal law (and the Constitution is the supreme law of the land) should be brought in a federal court.

I wonder why no one has made the obvious conclusion. You need to look at what Trump wanted to happen on Jan 6. He wanted the joint session to hear the reasons many states had put forth an alternate slate and the electors were to present the reasons for the alternate. This never happened because the “insurrection” started the minute Arizona was called to report. Trump was still speaking at that time.

Thus, the insurrection created precisely the opposite of what Trump wanted. The events on Jan 6 stopped the proceedings that Trump desperately needed.

Now, what gain did Trump get? He got no benefit from what happened.

Who did actually gain? The Democrats and mainly Joe Biden got all of the benefits. So, who most likely planned the insurrection? It could not have been Donald Trump because he lost everything and gained nothing. That is in no way indicative of a plan of action that makes the slightest sense.

Why am I the only one to make this point? This ain’t rocket medicine. This is just rock solid logic that should be irrefutable. But no one bothers to just THINK!

Vivek can pull a lot of votes from the left and still hold all the right. Republicans are going to vote a straight Republican ticket, We already know that.
